These Terms of Service govern your use of dogbagsusa.com and purchases from Dog Bags USA. In these Terms, "we," "us," and "our" refer to Dog Bags USA.
By using the site, placing an order, or selecting Net 30, you agree to these Terms and the policies linked below:

Do not use the site or place an order if you do not agree to these Terms.
1. Store and platform
Dog Bags USA operates this store. Shopify provides the ecommerce platform used to display products, accept orders, and support checkout.
2. Eligibility and lawful use
You must be legally able to enter into a binding agreement in the jurisdiction where you live or operate. If you place an order for a business, association, municipality, or other organization, you confirm that you are authorized to act for that organization and bind it to these Terms.
You may not use the site or our products for an unlawful purpose, interfere with site security, transmit malicious code, scrape protected information, impersonate another person, or infringe the rights of Dog Bags USA or another party.
3. Product information
We try to present product descriptions, specifications, colors, availability, and images accurately. Screen settings, manufacturing tolerances, and ordinary production variations may affect how a product appears. If we discover a material error, we may correct it and contact affected customers.
Product information, availability, and pricing may change before an order is accepted. A correction will not alter an accepted order unless you agree or the correction is permitted by law.
4. Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may decline or cancel an order because of stock availability, a pricing or description error, suspected fraud, payment problems, delivery restrictions, or another legitimate business reason.
If we cancel an order after collecting payment, we will refund or credit the applicable amount.
You are responsible for providing complete and accurate billing, shipping, contact, tax-exemption, and delivery information. You must promptly update us if that information changes before shipment.
5. Prices, payment, and taxes
Prices are stated in U.S. dollars unless we say otherwise. Payment is due using the method selected at checkout, except for a Net 30 order.
You are responsible for sales, use, excise, or similar taxes associated with an order unless we receive a valid exemption certificate before the tax is charged. A tax-exemption claim does not apply merely because a purchase order identifies the buyer as tax exempt.
Terms printed on or attached to a purchase order, procurement document, vendor portal, or other customer document do not add to or modify these Terms unless an authorized representative of Dog Bags USA expressly agrees to the change in a signed writing.
6. Net 30
Net 30 is available to business buyers without an application, approval process, finance charge, or fee. By selecting Net 30 or asking us to process an order on Net 30 terms, the buyer and its authorized representative expressly agree to these Terms.
The full invoiced amount is due 30 calendar days from the order date. The invoice will state the payment due date. Payment must be made in U.S. dollars without deduction, setoff, or withholding except where required by law.
Any invoice dispute must be sent to us in writing before the payment due date and must identify the specific amount disputed and the reason for the dispute. An invoice dispute does not delay payment of any undisputed amount.
Failure to pay an undisputed amount by the due date is a material breach of these Terms. If an account becomes overdue, Dog Bags USA may suspend Net 30 access, place pending or future orders on hold, require prepayment, cancel unshipped orders, and pursue collection of the unpaid balance. To the extent permitted by law, the buyer is responsible for reasonable documented collection costs, court costs, and attorney fees incurred to collect an overdue amount. These default remedies are separate from the no-fee use of Net 30.
7. Shipping, title, and risk of loss
Shipping, delivery, carrier services, and shipment problems are governed by our Shipping Policy.
Except where applicable law requires otherwise, title to and risk of loss for an order pass to the customer when we tender the shipment to a parcel carrier, an LTL freight carrier, or another carrier. Carrier delays, loss, or damage after tender do not change the customer's payment obligations.
Inspect every shipment promptly. Follow the reporting and documentation requirements in our Shipping Policy and Return and Refund Policy, including noting visible LTL damage or shortages on the delivery receipt whenever possible. We may assist with a carrier claim or provide a remedy under those policies without changing when title or risk of loss passed.
8. Returns, cancellations, damage, and refunds
Return eligibility, cancellations, damage or defect claims, wrong items, exchanges, and refunds are governed by our Return and Refund Policy. That policy is incorporated into these Terms.
9. Warranties
We make only the express product promises specifically stated in writing on the applicable product page or in an applicable published policy. The remedy for an item that arrives damaged, defective, incomplete, or incorrect is governed by our Return and Refund Policy unless we expressly provide another written warranty.
To the fullest extent permitted by law, and except for an express written warranty or right that cannot legally be excluded, the site, its content, and our products are provided "as is" and "as available." Dog Bags USA disclaims all other express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not guarantee that the site will always be available, uninterrupted, secure, or error free.
10. Third-party services and links
The site may use or link to third-party services, including Shopify, payment providers, carriers, and other service providers. Their services and websites may be governed by separate terms and privacy policies. We are not responsible for third-party content or services except to the extent required by law or expressly promised by Dog Bags USA in writing.
11. Intellectual property and submissions
The site content, product copy, graphics, logos, photographs, illustrations, and other materials owned by Dog Bags USA may not be copied, reproduced, republished, sold, or commercially exploited without our written permission, except as permitted by law.
If you voluntarily submit a review, photograph, suggestion, or other nonconfidential content, you confirm that you have the right to provide it and that it is lawful and accurate. You grant Dog Bags USA a nonexclusive, worldwide, royalty-free license to use, reproduce, edit for length or formatting, publish, and display that content in connection with our business. We may remove submitted content, but we are not required to publish it. We will handle personal information according to our Privacy Policy.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dog Bags USA and its owners, officers, employees, and agents from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from:
- your unlawful use of the site or a product;
- installation, use, or modification of a product contrary to written instructions;
- an unauthorized alteration of a product;
- content you submit that infringes another party's rights; or
- your material breach of these Terms.
This obligation does not apply to the extent a claim was caused by the negligence, willful misconduct, or legal violation of Dog Bags USA.
13. Limitation of liability
To the fullest extent permitted by law, Dog Bags USA will not be liable for lost profits, lost revenue, lost savings, lost business opportunity, business interruption, loss of use, or any indirect, incidental, special, punitive, or consequential damages arising from the site, a product, an order, or these Terms, even if we were advised that such damages were possible.
To the fullest extent permitted by law, the total liability of Dog Bags USA arising from a product, an order, the site, or these Terms will not exceed the amount actually paid to Dog Bags USA for the order giving rise to the claim.
These limitations do not apply to fraud, gross negligence, willful misconduct, personal injury caused by Dog Bags USA, or any liability that applicable law does not allow us to exclude or limit.
14. Events outside our control
Dog Bags USA is not responsible for delay or failure caused by events outside our reasonable control, including severe weather, natural disasters, carrier disruptions, labor interruptions, government action, utility or network failure, supplier disruption, or similar events. This section does not remove a remedy that applicable law requires.
15. Suspension and termination
We may suspend access to the site, decline an order, or end a customer relationship when reasonably necessary to prevent fraud, abuse, unlawful activity, nonpayment, security threats, or a material breach of these Terms. Obligations that arose before suspension or termination, including payment obligations, remain enforceable.
16. Governing law and courts
These Terms and any dispute arising out of or relating to the site, a product, or an order are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.
To the fullest extent permitted by applicable law, the parties consent to exclusive personal jurisdiction and venue in the state courts located in Whitfield County, Georgia, and, where federal jurisdiction exists, the United States District Court for the Northern District of Georgia, Rome Division. Nothing in this section prevents either party from bringing an eligible claim in the Magistrate Court of Whitfield County, Georgia.
17. Changes to these Terms
We may update these Terms to reflect changes in our store, operations, or legal requirements. The "Last updated" date identifies the latest revision. Changes apply prospectively unless applicable law requires otherwise.
18. Severability, waiver, and entire agreement
If a court finds part of these Terms unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A delay in enforcing a provision is not a waiver of the right to enforce it later.
These Terms, the policies incorporated into them, and any written agreement expressly signed by an authorized representative of Dog Bags USA form the entire agreement concerning the site and an order. If a signed written agreement conflicts with these Terms, the signed agreement controls. If a subject-specific policy conflicts with these Terms, that policy controls for that subject.
